Características Gerais do Mútuo Bancário em Portugal

Abstract

Neste trabalho, abordamos os principais elementos do contrato de mútuo bancário, sua formalidade, natureza jurídica, efeitos, forma de extinção normal e anormal, bem como conceitos correntes e importantes como o do mútuo feneratício e mútuo por escopo. Ainda, abordamos temas relativos ao contrato de mútuo, como a usura e o anatocismo, e as suas consequências, quando estão presentes nos contratos bancários. Ou seja, a anulabilidade ou nulidade destes dispositivos, bem como se deve resolver todo o contrato ou simplesmente alterar a cláusula viciada,onde concluímos que se faz importante sempre tentar manter os contratos porque esses possuem interesses e vantagens para a sociedade, para o estado e para a economia como um todo. Ou seja, mesmo nos contatos privados, existe um interesse público em que os mesmos sejam mantidos. Outro ponto tratado foi o do sinalagma dentro do contrato, bem como métodos extrajudiciais de solução de conflitos nos casos de litígios financeiros. Lembramos que atualmente vem sendo fomentada a prática de métodos extrajudiciais em todos os conflitos.
