¿Para la Constitución de 1823, existía la verdad judicial?

Abstract

De un tiempo a esta parte, somos espectadores de la exigida verdad jurisdiccional. Por ello, la tarea judicial ha perdido su norte y sentido primitivo de recinto para solucionar conflictos en un laboratorio de ficción. Como esto es imposible, incluso para quienes defienden tercamente esta postura, este ensayo pretende reavivar el debate y proponer el reconocimiento de que la tarea jurisdiccional posee un gran porcentaje de fe, una dosis de información dogmática y solo una pizca de hallazgo científico. Por lo tanto, la prueba no es la finalidad del proceso, sino solo un instrumento, un vehículo para alcanzar ese fin que es la pacificación de un problema llevado a juicio. Este y no la verdad judicial fue el motor inspirador de la primera Constitución de la República de 1823, como se aprecia desde su preámbulo hasta sus reglas de proscripción jurisdiccional.
