Abstract

Este artigo busca explicar, de forma compreensiva, quais as principais dificuldadesem provar culpa e atribuir responsabilidade jurídica ao EstadoLançador nos termos do Artigo III da Convenção de Responsabilidade de1972, que foi ratificada e incorporada ao ordenamento jurídico brasileirona forma do Decreto Nº 71.981 de 1973. O atual cenário é de crescente interesseno lançamento de satélites e na exploração do espaço sideral, entretanto,se faz necessário a compreensão dos riscos jurídicos pelo exercíciodas atividades espaciais. Por isso, objetivou-se analisar os pontos críticospara a compreensão do regime de responsabilidade internacional por danoscausados por objetos espaciais e demonstrar as principais dificuldadesem aplicar a responsabilidade estrita nos termos da Convenção de Responsabilidadede 1972. Utilizou-se da pesquisa bibliográfica e documentale do método dedutivo para abordar o assunto e concluiu-se que a dinâmicada prova no direito internacional, aplicado ao direito espacial, a ausênciade regras específicas que definam a abrangência do termo “culpa” naConvenção supramencionada, além das dificuldades técnicas e materiaisem identificar a origem do objeto que causou o dano, bem como provara extensão do dano, são algumas das principais causas impeditivas paraefetividade da aplicação de responsabilidade estrita no direito espacial.
