Azar, responsabilidad y participación delictiva: un análisis a la luz del debate acerca de la suerte moral

Abstract

La presente investigación tiene como objetivo proponer una relectura de los problemas tradicionalmente abordados por la dogmática de la participación delictiva, mediante el aprovechamiento de la indagación filosófica en el fenómeno de la así llamada “suerte moral” y su correlato jurídico como “suerte penal”. Para ello, primeramente se abordarán los lineamientos fundamentales a la noción de azar y su relevancia en la atribución de responsabilidad, tanto moral como jurídico penal, para después trasladar dichas consideraciones al debate relativo al fundamento de la participación delictiva. Finalmente, haciendo uso del aparataje conceptual de un modelo analítico del hecho punible, se examinará el complejo rol que juega el azar en la imputación jurídico penal a título de participación, dado su carácter irreductiblemente accesorio, concluyendo con el esbozo de una respuesta a la pregunta por la justificación del azar involucrado en el castigo, legamente consagrado, de quienes intervienen como partícipes en un hecho punible ajeno ; Versión original del autor
