Abstract

La investigación, refleja el resultado de un análisis histórico de la autonomía negocial, analizando los elementos del negocio jurídico, preceptos que en el evento de ser desconocidos por los sujetos negóciales se confluye en la nulidad del negocio jurídico, ya que, aborda como esencia que atañe a las restituciones mutuas, la cual se tiene como el resultado lógico de aquel acto negocial invalidado por la conculcación del orden jurídico, que previendo cualquier lesión, predispone la posibilidad de que las prestaciones generadas y recibidas con ocasión de aquel negocio viciado, dentro de lo posible sean reintegradas a su remitente con miras al mantenimiento del orden estatuido a través del retorno de toda obligación ya concedida, bajo el presupuesto de declararse nulo un contrato administrativo, las prestaciones del negocio jurídico estatal juegan un papel preponderante en la aplicación de las restituciones mutuas, se cataloga como presupuesto para la consolidación de la figura, pues sin contraprestación debidamente ejecutada no habría lugar a restituir lo dado, toda vez, que la naturaleza de la contraprestación depende de la materialización de la restitución, es decir, no resulta equiparable retrotraer los efectos por ejemplo de un contrato de ejecución instantánea a diferencia del contrato de trato sucesivo.

The investigation reflects the result of a historical analysis of business autonomy, analyzing the elements of the legal business, precepts that, in the event of being unknown by the business subjects, converge in the nullity of the legal business, since it addresses as essence that regards mutual restitution, which is considered the logical result of that negotiating act invalidated by the violation of the legal order, which, anticipating any injury, predisposes the possibility that the benefits generated and received on the occasion of that flawed business, within as far as possible they are returned to their sender with a view to maintaining the established order through the return of ali obligations already granted, under the assumption of declaring an administrative contract null and void, the benefits of the state legal business play a preponderant role in the application of refunds mutuals, classified as budget for the consolidation of the figure, because if In duly executed consideration, there would be no place to restore what was given, since the nature of the consideration depends on the materialization of the restitution, that is, not comparable to rol! back the effects, for example, of instantaneous execution contract unlike the contract of successive treatment.
