
El contrato internacional es un mecanismo idóneo para establecer las bases de una negociación en el contexto internacional. Desde el momento en que se tornó necesario internacionalizar el derecho mercantil para favorecer la contratación internacional, se realizaron estudios y análisis de las diferentes normativas que regulan este tipo de contratos. La Convención de Viena surge con la finalidad de establecer un régimen moderno, con cierta uniformidad y con una mayor equidad respecto de los contratos internacionales de compraventa. Con el fin de contribuir con la seguridad jurídica a aquellos intercambios entre agentes internacionales y a la par intentar una disminución de los gastos operacionales. Los objetivos del presente trabajo están determinados por una revisión de la normativa. Por esto, para el desarrollo del presente trabajo, se expone el siguiente interrogante, sobre el incumplimiento esencial del contrato de mercancías a la luz de la Convención de Viena y los Principios UNIDROIT, como punto de estudio de esta temática: ¿Cuáles son los elementos que debe considerar, la víctima, el juez o el árbitro, para pedir y declarar la resolución del contrato de mercancías como consecuencia del incumplimiento esencial, teniendo en cuenta que no se encuentra contemplada expresamente por la Convención de Viena?
The international contract is an ideal mechanism for establishing the foundations of a negotiation in the international context. Since it became necessary to internationalize commercial law to facilitate international contracting, studies and analyses of the various regulations that govern such contracts have been conducted. The Vienna Convention emerged with the aim of establishing a modern regime, with some uniformity and greater fairness regarding international sales contracts. Its goal is to enhance legal certainty for exchanges between international parties while also attempting to reduce operational costs. The objectives of this work are determined by a review of the regulations. Therefore, in the course of this work, the following question is posed, regarding the essential breach of the goods contract in light of the Vienna Convention and the UNIDROIT Principles, as the focal point of this theme: What are the factors that the victim, the judge, or the arbitrator should consider when requesting and declaring the resolution of the goods contract as a result of an essential breach, considering that it is not expressly provided for by the Vienna Convention?
