Abstract

Analizar desde el punto de vista del marco constitucional, sentencias de la corte constitucional y la corte suprema de justicia y pronunciamientos de la SIC con respecto a la regulación del régimen de la libre competencia económica en Colombia, reflexionando además acerca de la aplicación de la cláusula general de la competencia art. 1 de la ley 155 de 1959 por parte de la SIC en los casos que se da su vulneración y su posterior demanda ante la Corte Constitucional por resultar ser inconstitucional, pero para comprender su aplicación e interpretación de las normas de libre competencia pasara a estudiarse las distintas escuelas existentes, indagando los casos de excepcionalidad a la aplicación de la cláusula general de la libre competencia económica y como las cláusulas de no competencia han sido valoradas en Colombia como también en otros países y la tipología de los contratos en los que es frecuente el uso de las cláusulas de no competencia

Analyze from the point of view of the constitutional framework, judgments of the constitutional court and the supreme court of justice and pronunciations of the SIC regarding the regulation of the regime of free economic competition in Colombia, also reflecting about the application of the clause general competition art. 1 of law 155 of 1959 by the SIC in the cases of its violation and its subsequent claim before the constitutional court because it proves to be unconstitutional, but to understand its application and interpretation of the rules of free competition, the rules will be study. different existing schools, investigating the cases of exceptionality to the application of the general clause of free economic competition and how the non-competition clauses have been valued in Colombia as also in other countries and the type of contracts in which the use of non-competition clauses
