
El presente trabajo de grado está dirigido a determinar si el sistema de nomenclatura, clasificación y remuneración del empleo público, utilizado como técnica para fijar el salario de los servidores públicos particularmente vinculados a las entidades del orden territorial, materializa el principio laboral constitucional de carácter universal, denominado “A trabajo de igual valor, salario igual”, se presentará un análisis conceptual de las nociones de nomenclatura, clasificación y remuneración desde sus desarrollos jurisprudenciales y doctrinales. Así mismo se estudiará la evolución jurisprudencial y legal del principio “a trabajo igual, salario igual” en el sector público, para luego presentar un análisis crítico a la técnica de remuneración empleada por el Estado Colombiano, acabando con un análisis de las otras técnicas salariales que eventualmente podrían sustituir el sistema vigente.
This master’s thesis aims at determining if the Colombian system of nomenclature, classification, and remuneration of public employment that is used to set the salary of public servants hired at the sub national level (states and municipalities), complies with the constitutional labor, universal, principle of “equal pay for work of equal value.” First, the paper presents a conceptual analysis of nomenclature, classification, and remuneration in jurisprudence and doctrine. Second, it introduces the jurisprudential and legal evolution of the principle “equal pay for work of equal value” in the public sector. Third, it contains a critical analysis of the Colombian State’s remuneration approach. The paper closes with the analysis of alternate remuneration approaches that could substitute the current system.
