Abstract

“La crisis financiera iniciada en el año 2007 ha tenido unas repercusiones difícilmente comparables en términos históricos. No sólo ha cuestionado determinadas prácticas que eran habituales en los mercados financieros, sino que ha llegado a cuestionar el modelo de capitalismo financiero imperante en la actualidad. Con independencia de la incidencia concreta en Estados individuales, lo cierto es que prácticamente todos los legisladores a nivel mundial están adaptando sus respectivas legislaciones a nuevas formas en la que los operadores actúan en los mercados financieros. (…)Los trabajos que componen esta monografía abordan desde una perspectiva penal la nueva realidad de los mercados a raíz de la crisis financiera. En primer lugar, se abordan los fenómenos complejos en la dimensión privada de los mercados, tales como el shortselling (ventas en corto) o la high frecuency trading (negociación de alta frecuencia). En segundo lugar, se realiza una aproximación a la esfera más pública de la deuda soberana europea y a la tarea que el Derecho penal europeo está llamado a desempeñar en el futuro respecto de la protección de la misma. Con ello no se aspira a dar una respuesta penal definitiva a un entorno tan cambiante como son los mercados financieros, sino únicamente a señalar algunos de los ámbitos necesitados de atención jurídico-penal.” De la presentación
