Abstract

“La construcción de un derecho de obligaciones y contratos europeo es un proceso que ha ocupado los esfuerzos de la mejor doctrina los últimos treinta años con una intensidad creciente, y que probablemente lo seguirá haciendo en los próximos decenios.(…) Ante el empuje de la doctrina, las instituciones políticas europeas asumieron el reto, primero promoviendo la elaboración de un Marco Común de Referencia del derecho contractual europeo y ahora, en lo que por el momento es el último eslabón de la cadena, un proyecto de Reglamento sobre un derecho común europeo de la compraventa, que no crearía un sistema de reglas obligatorio, sino optativo para las partes que deseen someterse a él.(…)Para que un transplante, sea jurídico o sea de otro tipo, arraigue y fructifique, debe encontrar un receptor dispuesto a ello. Como cualquier semilla, necesita un terreno labrado, abonado y húmedo. El derecho comparado, el conocimiento y la circulación de instituciones y modelos jurídicos, el diálogo transfronterizo entre juristas, siempre redunda en beneficio del derecho, pues agudiza el descubrimiento de ámbitos susceptibles de mejora, desvela lagunas, estimula su perfeccionamiento, lo vivifica. De especial interés resulta la comunicación entre juristas de ambos lados del hemisferio, en particular españoles y sudamericanos, que compartimos unas mismas raíces legales”.De la nota del autor
