Teoría geenral del proceso civil

Abstract

Proceso es un término genérico que no es propio ni exclusivo del lenguaje jurídico y, en particular, del lenguaje que mira a la ciencia del derecho procesal civil. Conforme a una acepción general se llama proceso el momento dinámico de cualquier fenómeno, o sea de todo fenómeno en su devenir. Tenemos así un proceso físico, un proceso químico, un proceso fisiológico, un proceso patológico, todos los modos de decir que sirven para representar un momento de la evolución de cualquier cosa. En nuestro caso, proceso es el desarrollo de una de las tres funciones fundamentales del Estado: la función jurisdiccional o judicial. Podemos definir el proceso civil como el conjunto de las actividades de los órganos jurisdiccionales y de las partes, necesarias para el desenvolvimiento de la función jurisdiccional civil.
