Abstract

La ciencia del Derecho tiene hoy una gran misión: la civilización de los pueblos, el movimiento progresivo, continuo, infinito, fatal de los cuerpos sociales a través de la dolorosa vía crucis de tantos errores y de tantas injusticias. Entre los nuevos estudios jurídico-sociales que interesan vivamente al hombre de ciencia y al estadista, hay el del procedimiento penal, que siguiendo la dirección del espíritu humano, las transformaciones sociales, es la medida cierta, el modo seguro de apreciar la cultura de los Estados por su íntima relación con la organización política de los mismos. El procedimiento penal comprende la resolución del más interesante entre los problemas jurídicos, esto es, el de conciliar el proceso y en el juicio penal la tutela jurídica de los co-asociados contra los malvados con la tutela jurídica de los inocentes, contra las molestias y el peligro de una acusación temerariamente formulada FILIPPO MANDUCA
