Abstract

Es indudable que en los países de occidente la pena capital se halla en su lecho de muerte. Pero, como una anciana llena de apego a la vida, se resiste a morir. Los que junto a la cama aguardan el instante del fallecimiento, esperan inútilmente el momento final. Los síntomas de la agonía son inconfundibles, pero su consumación es improbable. El lecho de muerte se ha convertido en cobijo de una enfermedad crónica. Una mirada al atlas del Derecho nos muestra que el territorio dominado por la pena de muerte es muy extenso; que la mayor parte de la humanidad todavía cree en su necesidad absoluta y se sacrifica dicha pena. Quienes recomiendan la pena de muerte y creen que produce consecuencias favorables que justifican su mantenimiento, debe-rían reconocer que los países que consideran ejemplares se encuentran en un estado de evolución social más que dudoso. El símbolo, otrora brillante, de la justicia punitiva se ha convertido en distintivo de un subdesarrollo cultural y político, que se mantiene, tanto si se presenta en forma totalitaria como democrática, con un despotismo feudal de clases, racista y dogmático.
