Hipótesis de incidencia tributaria

Abstract

El contenido esencial de cualquier norma jurídica es su mandato principal. El contenido de las normas tributarias, esencialmente, es una orden o mandato, para que se entregue al estado (o persona por él, por ley, designada) cierta suma de dinero. En otras palabras: la norma que está en el centro del derecho tributario es aquella que contiene una orden: “entregue el dinero al estado”. La norma de derecho tributario material no es diferente, por lo tanto, de las demás normas jurídicas. Si no, lo que le da entidad, distinta de las demás es el contenido de exigencia de su orden: el comportamiento de llevar “dinero a las arcas públicas”. En general, concordamos con las leyes, o por causa de la autoridad del estado, que la impone, o por causa de la justicia de su contenido. De cualquier forma – concordemos o no – debemos obedecerlas bajo pena de acarrear con la respectiva sanción. A este carácter de la norma jurídica, que le permite atribuir capacidades y efectos a las cosas y comportamientos, que le da la virtud de imputar sus propios efectos (jurídicos) a las cosas que recaen bajo su poder, se le da el nombre de atribución.
