Control constitucional de las decisiiones judiciales

Abstract

Lógica consecuencia de la supremacía constitucional es atribuirle a algún órgano la potestad de defenderla, pues de lo contrario esta supremacía quedaría a la buena voluntad del gobernante o los órganos de poder. Por ello, los ordenamientos jurídicos consagran, con sus respectivas peculiaridades, medios de defensa de la supremacía constitucional, creando mecanismos e instituciones especializados para cumplir con la tarea de encarrilar a todos los operadores jurídicos por la vía de la Constitución. Pues bien, considerando las distintas alternativas, desde sus inicios el sistema constitucional estadounidense se separó de los modelos europeos, donde se desconfiaba del Poder Judicial como órgano encargado de tener la última palabra en materia de defensa de la Constitución, pues en la gran mayoría de los ordenamientos europeos de la época, el Parlamento era quien debía asumir ese rol de garante de la Constitución, al contar con la representación popular.
