Abstract

Con el título Reincidencia: origen, causas, consecuencias y posibles soluciones, el Prof. Dr. David G. Mangiafico – jurista prolífico, cuya obra doctrinaria trasciende las fronteras de nuestro país – nos ofrece un estudio integral de este instituto jurídico. El libro es el fruto de una meditada lectura de una rica bibliografía (nacional y extranjera) y de un análisis riguroso de la doctrina judicial (argentina y comparada) desenvuelta en derredor de la reincidencia, deteniéndose en los meandros que el discurrir del instituto ofrece; fijando posturas personales, científicamente fundadas, que demuestran, a cada instante, el dominio sobre la materia. En este sentido, la obra se caracteriza por su completitud, colmando una laguna, tanto en la literatura argentina como latinoamericana, respecto del tema investigado. La lectura del trabajo despierta innumerables reflexiones; de las cuáles me permito compartir solo algunas. La obra de Mangiafico constituye un trabajo de gran valor, porque ahonda, generosamente, en todos los entresijos del instituto y lo hace, con agudeza, espíritu dogmático, actitud constitucional y, especialmente, con una mirada interdisciplinaria; todo lo cual la convierte en un libro indispensable, tanto para el práctico como para el teórico; esperando que también haga llegar sus aguas vivificantes a los operadores penitenciarios y que aguce la reflexión de nuestros parlamentarios, de cara a futuras revisiones del ya centenario Código Penal Argentino; para replantear, con seriedad, la discusión que permita, de una vez para siempre, abordar – sin pasiones, sin premura mediáticas y con cientificidad y responsabilidad pública – los espinosos problemas de legitimad constitucional que impregnan a la reincidencia.
