Abstract

El presente texto se enmarca dentro del Proyecto “Estado de Derecho internacional” de la Universidad Nacional Autónoma de México y los orígenes de las normas jurídicas internacionales en un sistema jurídico internacional que represente al Estado de Derecho internacional. Es un aporte a la juridificación del Derecho internacional público y su investigación se efectuó en el Centro de Estudios de la Universidad de Heidelberg en Santiago de Chile, biblioteca Maughan del King´sCollege de Londres y una visita de discusión en la Universidad Nacional Autónoma de México. Se propone que el conjunto normativo debe ajustarse a ciertos criterios para obligar a los sujetos de Derecho internacional e, inclusive, nacionales no sólo en base a las normas jurídicas constitucionales. Este punto, criterios de definición de la obligatoriedad es de suyo de interés en la planificación jurídica en todo aspecto del Derecho para que las normas jurídicas contengan visos de obligatoriedad internacional.
