Abstract

Los trabajos que componen este libro se recogen en tres bloques, referidos respectivamente a los derechos reales, a los con-tratos y a las sucesiones.A pesar de la lógica falta de perspectiva que da la propia autoría, creo no equivocarme en el juicio si digo que uno de los elementos unificadores de todos estos trabajos es su perspectiva diacrónica y el continuo recurso a la historia para dar solución a los interrogantes planteados. Comparto en su esencia la íntima convicción expresada por Juan Vallet de Goytisolo al decir que “todo el Derecho civil es historia”, y considero que el jurista que aborde los problemas del Derecho privado desprendido de sus contextos formativos no podrá entender muchas veces el sentido profundo de las instituciones. En consecuencia, a la hora de buscar explicación a las contradicciones que parecen existir en los textos legales, no debe olvidarse que los artículos decimonónicos de nuestros Códigos civiles son, en la mayor parte de los casos, fórmulas de sedimentación de estratos anteriores: sólo una perspectiva que salte por encima del texto codificado hacía sus antecedentes puede permitirnos salvar dichas contradicciones, encontrando las razones que han dado lugar a las soluciones vigentes.
