Abstract

El Derecho como artefacto es una nueva teoría en la filosofía del derecho que comienza a tener una mayor difusión en los ámbitos académicos y que se caracteriza por su claridad expositiva, lo novedoso de su planteamiento y la posibilidad de abrir un nuevo camino de reflexión en la referida disciplina. El único problema de la teoría del Derecho como artefacto es que siendo todavía tan elemental es vulnerable a cualquier crítica ontológica, epistemológica y semántica. De hecho, la posibilidad de aceptar que una teoría de este tipo es la que mejor describe la naturaleza de nuestras instituciones, implicaría literalmente refundar el sistema jurídico en la tradición romano – germánica, a la cual Latinoamérica pertenece.
