Abstract

En el trascurso de más de dos decenios de práctica judicial he llegado a convencerme de que no hay procedimiento probatorio sin trampas y peligros. Hasta los casos que parecen claros entrañan el riesgo del error. El escollo para la jurisprudencia no está en el error de derecho, sino en el error de hecho. Pero los errores de hecho tienen origen en un procedimiento probatorio mal o deficientemente practicado, en una incorrecta apreciación de la prueba, o en la falta de experiencia psicológica. De ahí que me parezca oportuno colocar la prueba en el centro de las reflexiones críticas y señalar tanto las ventajas y desventajas de los distintosmedios de prueba como las fuentes de errores inherentes a ellos. Por cierto que no será novedoso todo lo que tenga que observar al respecto. La presente disertación constituye unamezcla de teoría y práctica, respaldada no tanto por la ciencia, cuanto por la experiencia de un jurista a quien le ha cabido en suerte prestar su colaboración a la jurisprudencia judicialen todas las funciones posibles.
