Abstract

Der Sammelband vereint juristische und philosophische Überlegungen, die sich im Blick auf die zentrale Rolle der Menschenrechte in der internationalen Politik und Staatengemeinschaft folgende Fragen beschäftigen: Inwiefern entsprechen den Menschenrechten auch Menschenpflichten? Wie kann die Einheit von liberalen Freiheitsrechten mit sozialen Rechten begründet werden? Wie lässt sich die Menschenwürde zu einem Rechtsbegriff formulieren? Welchen Beitrag leistet das antike und christliche Denken zu unserem heutigen Begriff der Menschenrechte? Ist es möglich einem Menschen seine ureigenen Rechte abzusprechen und ihm somit seinen Personenstatus abzuerkennen? Inwieweit besteht ein Zusammenhang zwischen demokratischer Staatsform und den Menschenrechten? In welchem systematischen Verhältnis stehen Menschenrechte und bürgerliche Grundrechte? Mit Beiträgen von Hans-Helmuth Gander, Georg Lohmann, Christian Tomuschat, Kurt Seelmann, Ada Neschke, Verena Krenberger, Amnon Lev und Thomas Dürr.
