La distinción remunerativa justificada: Excepción del derecho a la igualdad

Abstract

Mediante este artículo se pretende explicar principalmente con ayuda de la jurisprudencia del Tribunal Constitucional y de la Corte Suprema de Justicia de la República, la posibilidad válida y legal que tiene el empleador para otorgar distintas remuneraciones a trabajadores que prestan sus servicios en un mismo puesto o una misma categoría, siempre y cuando se justifique de manera objetiva y razonable esa diferencia; para lo cual, se analizan los componentes que implican y constituyen el derecho a la igualdad, los supuestos de hecho que se pueden observar para implementar una distinción remunerativa y los criterios que permiten aplicar una distinción salarial, de tal manera que, se configure una excepción del derecho a la igualdad, al pagar diferentes remuneraciones ante igual trabajo sin que se vulnere el principio de no discriminación.
