
En el presente artículo, el autor tiene por objetivo analizar la naturaleza jurídica del derecho a la desconexión digital y sus mecanismos de protección por parte de la Inspección del Trabajo. Para ello, previamente se estudia el origen y las principales características del trabajo remoto en el Perú, por ser la modalidad para la cual se ha creado el derecho a la desconexión digital. Sin embargo, para el autor este novedoso derecho debe extenderse a todo trabajador, incluyendo aquellos que realizan trabajo presencial.
