Nanotecnologia e medicamentos: a necessidade de uma regulamentação jurídica brasileira para a proteção do direito fundamental à saúde

Abstract

Texto que analisa a nanotecnologia aplicada na fabricação de medicamentos, alguns deles já comercializados no mercado brasileiro, ressaltando o fato de que inexiste um marco regulatório que auxilie a Agência Nacional de Vigilância Sanitária na identificação da eficácia e segurança desses fármacos, situação que pode colaborar para um consumo com potencial grau de toxicidade resultante das interações entre nanomateriais e sistemas biológicos. Assim, a problemática reside em discutir se a falta de um regulamento normativo específico concernente às nanotecnologias e, em especial, aos nanomedicamentos, viola o direito à saúde. Para tanto, o estudo utiliza metodologia exploratória, análise qualitativa e a técnica da pesquisa bibliográfica, concluindo-se que a regulação dos nanomedicamentos exige brevidade para que sua utilização seja segura e eficaz, protegendo-se o direito fundamental à saúde do cidadão.
