La familia multiespecie en el ordenamiento jurídico colombiano: un análisis a partir de los derechos de los animales

Abstract

La categoría jurídica de los animales presenta una complejidad creciente, toda vez que estos no encajan completamente en las nociones tradicionales de sujeto u objeto. La afirmación anterior responde a una convergencia entre los enfoques antropocéntrico, biocéntrico y ecocéntrico, donde, a partir de este último, se plantea la posibilidad de que los llamados seres sintientes sean reconocidos como parte del hogar donde residen, a pesar de la carencia de una regulación precisa frente a esta tipología familiar. Por tanto, el objetivo del presente artículo busca establecer los derechos de los animales como parte de la familia multiespecie a través de una investigación jurídica, dogmática y con enfoque hermenéutico, donde se destaca la necesidad de plantear una regulación clara como respuesta a la protección de nuevas formas de relacionamiento entre animal y humano.
