Abstract

La Corte Suprema de Justicia, Sala de Casación Civil, decidió revocar el fallo de primera instancia promulgado por el Tribunal Superior de Distrito Judicial de Manizales y, en su lugar, conceder la protección solicitada por vía de Habeas Corpus en favor del oso andino de anteojos, llamado “Chucho”. De esta manera, se obliga judicialmente al zoológico de Barranquilla a liberar y remitir inmediatamente a Chucho a un área que cumpla con las condiciones propias de su especie, su hábitat natural, en donde había vivido más de 18 años. Concluye la Corte que los animales son sujetos de derecho en tanto legislativamente han sido reconocidos como seres sintientes, lo cual implica que la garantía supra legal de libertad de las personas, Habeas Corpus, no sea incompatible con la condición jurídica del animal no humano.
