Abstract

La Sentencia objeto de comentario anula los permisos que se habían otorgado a la Fundación Instituto de Inmunología de Colombia (FIDIC) para capturar primates en la Amazonía colombiana, con el fin de usarlos en la investigación para obtener una vacuna contra la malaria. El Consejo de Estado Colombiano (CEC) resuelve en este caso el recurso de apelación interpuesto contra la Sentencia de mayo de 2012, proferida por el Tribunal Administrativo de Cundinamarca. El autor comenta los aspectos más relevantes de la sentencia citada que, además de resolver el caso, hace unas consideraciones muy importantes respecto al trato y al uso que los humanos hacen de los animales, llegando el CEC a posicionarse a favor del reconocimiento de derechos a favor de los mismos. The Sentence which is the subject of this commentary annuls permits that had been awarded to the Fundación Instituto de Inmunología de Colombia (Colombian Institute of Immunology Foundation, FIDIC) to capture primates in the Colombian Amazon, for the purpose of using the primates in research to obtain a malaria vaccine. The Consejo de Estado Colombiano (Council of the State of Colombia, CEC) in this case resolves the appeal lodged against the Sentence from May 2012, proffered by the Administrative Court of Cundinamarca. The author comments on the most relevant aspects of the cited sentence which, in addition to resolving the case, includes some very important considerations with regards to the treatment and use of animals by humans, causing the CEC to position itself in favor of recognizing rights for non-human animals.
