Abstract

[ES] A partir de un detenido estudio en torno a la importancia de la noci?n de la diligencia debida para un adecuado desarrollo de las actividades empresariales en el espacio global, el presente art?culo analiza el contenido de la Propuesta de Directiva sobre la diligencia debida de las empresas en materia de sostenibilidad, con especial atenci?n a la protecci?n de los derechos humanos en el trabajo. El texto elaborado por la Comisi?n Europea parte de la consideraci?n de los procesos de diligencia debida como una obligaci?n de las empresas, cuya aplicaci?n se extiende a todas las entidades integradas en su cadena de valor de manera ?estable?. En este contexto, las reglas en materia de responsabilidad civil constituyen el elemento m?s innovador de la Propuesta, pues se establece una vinculaci?n directa entre el incumplimiento de los deberes empresariales y la responsabilidad civil relativa a los impactos adversos que pudieran materializarse. No obstante, ello no impide abordar las dificultades que afectan a la tramitaci?n y resoluci?n de procedimientos judiciales suscitados con ocasi?n de los da?os a los derechos humanos laborales en otros continentes. En definitiva, puede afirmarse que el proyecto de texto articulado representa un sustancial avance en el terreno de la diligencia debida obligatoria que sujeta el desarrollo de las actividades empresariales en el espacio global, si bien presenta aspectos susceptibles de mejora y puntos d?biles respecto de las recomendaciones formuladas anteriormente por el Parlamento Europeo, elementos todos ellos puestos de manifiesto en el estudio que aqu? se presenta. [EN] Based on a detailed study of the importance of the notion of due diligence by companies, this article analyses the content of the Proposal for a Directive on Corporate Sustainability Due Diligence, with special attention to the protection of human rights at work. The text drafted by the European Commission starts from the consideration of due diligence processes as an obligation for companies, whose application extends to all companies in the value chain with established business relationship. In this context, the rules on civil liability are the most innovative element of the Proposal. A direct link is established between the breach of corporate duties and civil liability for adverse impacts. However, the difficulties of legal proceedings for human rights harms in other continents are also explored. It can be affirmed that the draft text represents a substantial advance in the field of mandatory due diligence requirements, although it does present aspects that could be improved and weak points with respect to the recommendations previously formulated by the European Parliament, all of which are highlighted in the study presented here.
