Populismo punitivo; ¿solución o placebo social?

Abstract

Introducción: El populismo punitivo mantiene una posición dicotómica, se expresa como una tendencia que obtiene la aprobación ciudadana, mediante el endurecimiento de penas, mientras que el discurso político lo posesiona como una solución eficiente a problemas sociales como la delincuencia y la inseguridad. Desarrollo: La investigación explica los antecedentes del populismo punitivo y a la par identifica si dicha tendencia opera como una solución a las problemáticas ciudadanas o actúa como un simple placebo social, el presente estudio se realiza a la luz del método comparativo y la revisión jurídica doctrinaria a fin de dar respuesta a esta disyuntiva. Aplicaciones prácticas o futuras líneas de investigación: Es preciso que los gobiernos inclinen su accionar hacia la generación y ejecución de programas de prevención del delito y de mejoramiento del sistema penal, en consonancia con los principios de gradualidad y justicia. Conclusiones: Finalmente se evidencia que el populismo punitivo constituye una fuerte herramienta discursiva utilizada por la clase política en la región, que consigue la aprobación ciudadana en base al subjetivismo pero que está lejos de solucionar los problemas sociales.
