Se analiza en este artículo la situación jurídica en la que se encontraba la mujer en el antiguo ius civile, esto es, durante la época romana más antigua, en la que estaba vigente el matrimonio cum manu. Asimismo, se estudia la coemptio como negocio jurídico solemne, por medio del cual la mujer podía cambiar su status jurídico. Finalmente se concluye que el antiguo ius civile no era discriminatorio para la mujer si se analizan sus instituciones desde un punto de vista antropológico.
This article analyses the legal situation of women in the ancient ius civile, i.e. during the earliest Roman period when cum manu marriage was in force. Coemptio is studied as a solemn legal transaction by means of which women could change their legal status. It is explained that the ancient ius civile was not discriminatory towards women if its institutions are analysed from an anthropological point of view.
