ABSTRACT: This article is a critical analysis of the Venezuelan case law acceptance of parties’ waiver to arbitration. The critics are organized in two groups. Firstly, from the obligation law perspective; secondly, from the arbitration law perspective. The objective is to contribute with the release of this rara avis of Venezuelan arbitration law to its place of origin.
