La efectividad del Tribunal Electoral y el INE: los derechos humanos y los conflictos laborales en México

Abstract

Se revisan los juicios para dirimir los conflictos o diferencias laborales entre el Tribunal Electoral del Poder Judicial de la Federación y sus servidores, así como entre el Instituto Nacional Electoral y sus servidores, durante la última década en México y con respecto a las garantías judiciales mínimas contenidas en la Convención Americana de Derechos Humanos. Se aborda en tres partes: la primera relativa al antecedente histórico del derecho laboral burocrático a partir de la Constitución Federal de 1917 y hasta la creación de los juicios laborales en materia electoral, la segunda aborda el concepto de efectividad y su relación con los derechos humanos y en la tercera se revisa el procedimiento de resolución respectivo y se expone la necesidad de contar con un recurso judicial efectivo
