
O ónus da prova e os standards de prova são dois institutos que têm origem no antigo sistema de valoração legal ou taxada da prova, no qual tinham o seu pleno significado. No entanto, no sistema de livre apreciação, o instituto do ónus da prova deixa ter qualquer utilidade, e os standards de prova convertem-se em simples imitações das antigas categorias “probatio plena” e “probatio semiplena” que se revelam impossíveis de objetivar. No presente artigo detalham-se e justificam-se extensamente as anteriores conclusões.
