Abstract

O presente trabalho tem como objetivo uma abordagem empírica das decisões monocráticas proferidas pelos Ministros do Supremo Tribunal Federal nas Ações Diretas de Inconstitucionalidade, especificamente quanto à apreciação de medidas cautelares. A pesquisa parte do problema de incompatibilidade entre as normas que regem a apreciação das ADI's no Supremo Tribunal Federal e o fenômeno da monocratização. Inicialmente, serão estudados o procedimento das Ações Diretas de Inconstitucionalidade e as possibilidades legais e constitucionais de atuação do relator em ADI's. Em seguida, serão contemplados os exemplos da prática e seus contornos qualitativos. Na segunda etapa do trabalho, serão analisadas informações disponibilizadas pelo Supremo Tribunal Federal, para levantamento das características quantitativas do fenômeno da monocratização. Por fim, será feita análise da compatibilidade do julgamento das Ações Diretas de Inconstitucionalidade à luz da monocratização com as normas e princípios que regem seu procedimento
