Entre o autoritarismo e o judiciarismo: o espectro do Poder Moderador na República (1889-1945)

Abstract

Resumo: O presente artigo investiga os diferentes sentidos atribuídos na República ao conceito de “poder moderador”. Argumenta-se que, embora a crise do regime na década de 1910 tenha levado à revalorização da herança do Império, transmitida pela historiografia do Instituto Histórico e Geográfico Brasileiro (IHGB), cada qual se agarrou a uma interpretação diferente do Poder Moderador para interpretá-lo e justificar reformas distintas: a autoritária, que fortaleceria o presidente; a judiciarista, que favoreceria o STF; e a moderada, que recriaria um quarto poder na forma de um conselho de Estado. A proposta por estabelecimento de um quarto poder pelo governo, articulada no processo constituinte de 1932-1934, fracassaria diante da preferência dos judiciaristas que defendiam a autoridade do Supremo Tribunal, de um lado, e dos militaristas, que preferiam um Conselho de Segurança Nacional. A ditadura do Estado Novo aparece como resultado da impossibilidade de compatibilizar as exigências contraditórias de norma e exceção, liberalismo e nacionalismo, pluralidade e unidade, direitos fundamentais e segurança nacional.
