Genealogia do Ato Institucional – entre legalidade, exceção e legalidade excepcional

Abstract

O presente artigo faz uma genealogia do ato institucional para compreender as ambiguidades constitutivas do constitucionalismo brasileiro que envolvem a convivência entre normalidade e exceção. Essa forma normativa foi central para a legalidade autoritária estabelecida na ditadura militar brasileira, entretanto não criação daquele regime. Foram recuperados debates em assembleias constituintes e em jornais desde a década de 1930 que mostram que mesmo antes de ser formalmente nomeado ato institucional esse termo já era utilizado para descrever ato normativo em que se pretendeu tratar de situação em que convivia poder constituinte e poder constituído. Desta forma, a genealogia do ato institucional nos permite avaliar como forma mobilizados debates que envolviam a resposta jurídica a mudanças da ordem política e constitucional. Neste sentido desvelam os fios que mobilizam revolução, constituição, poder constituinte e poder constituído.
