Abstract

La Ley N° 29618, promulgada el 24 de noviembre de 2010, establece la presunción de que el Estado es poseedor de sus inmuebles y declara como imprescriptibles los bienes inmuebles de dominio privado estatal. Esta norma genera controversia al chocar con el artículo 73° de la Constitución Política del Estado, que sugiere la posibilidad de prescripción de los bienes de dominio privado estatal. La administración, registro y defensa de los bienes estatales tienen antecedentes legislativos desde los inicios de la República, pero las normas aplicadas han carecido de alcance general. Incluso, códigos civiles anteriores regulaban aspectos relacionados con la disposición de los bienes estatales. Este marco normativo ha influido en el desarrollo del derecho administrativo peruano, especialmente en lo referente al tratamiento del patrimonio público, aunque en ocasiones las disposiciones hayan estado incluidas en normas de derecho privado.
