La prohibitione sopra l'estrattione come primo strumento di tutela dei beni culturali nella penisola italiana

Abstract

Il nostro Codice dei beni culturali e del paesaggio, entrato in vigore nel 2004, da un lato, sancisce il divieto di «uscita definitiva» dei beni culturali mobili dal territorio italiano e dall’altro ne limita l’esportazione dal territorio dell’Unione Europea. Muovendo dalla disciplina attuale, il contributo intende dimostrare come la stessa abbia radici antiche ed il divieto di esportazione senza licenza risalga all’Età Moderna, quando la maggioranza degli stati italiani lo introdussero quale strumento di tutela dei beni culturali con il dichiarato scopo di conservare il lustro e il decoro delle città.

Our Code of Cultural Heritage and Landscape, which came into force in 2004, on the one hand sanctions the prohibition of the "permanent exit" of movable cultural property from Italian territory and on the other limits its export from the territory of the European Union. Starting from the current regulation, the contribution aims to show how it has ancient roots and the ban on unlicensed export dates back to the Modern Age, when the majority of Italian states introduced it as an instrument for the protection of cultural property with the declared aim of preserving the luster and decorum of cities.
