El desarrollo decisional de la jurisprudencia del Consejo de Estado colombiano en cuanto a la reparación del daño ambiental consecutivo directo: aplicación de la metodología de la línea jurisprudencial

Abstract

The following outlines the process of applying the jurisprudential line methodology proposed by López Medina (2006) to those Colombian judicial rulings that address the study of the following factual scenario: (A) a state entity causes, through its conduct (active or passive), pure environmental damage, from which (B) a subjective impact on specific individuals arises, depriving them of the use or enjoyment of the values that the surrounding ecosystems provided them before the damage. This aims to collect the solutions that judges in Colombia have given to litigation involving this type of damage to determine the decision-making trend in this regard. This is, therefore, the methodological complement to the research article "The Decision-Making Development of the Jurisprudence of the Colombian Council of State Regarding the Reparation of Direct Consecutive Environmental Damage," published by Naturaleza y Sociedad. Desafíos Medioambientales, which deeply reflects on the decision-making development of the jurisprudence of the Colombian Council of State regarding the reparation of direct consecutive environmental damage.
