Das Bayerische Konkordat von 1924

Abstract

Aus Anlass des 100-jährigen Jubiläums beleuchtet der Artikel die historischen Hintergründe, die Entstehungsgeschichte, die staatskirchenrechtlichen Inhalte und die Weiterentwicklung des Bayerischen Konkordats von 1924/25. Dieses war in Deutschland das erste Konkordat nach dem Ende der Monarchie 1918 und der Promulgation des Codex Iuris Canonici von 1917. Dem Heiligen Stuhl gelang es weitgehend, Maximalforderungen im Sinne des Kirchenrechts durchzusetzen, weil sich der Freistaat Bayern unbedingt einen möglichst großen Rest an Souveränität beziehungsweise Föderalität innerhalb der Weimarer Republik bewahren wollte. Da das Konkordat bis heute die rechtliche Basis des Verhältnisses zwischen Staat und Kirche in Bayern darstellt, können aktuelle Herausforderungen im bayerischen Staatskirchenrecht nur mit Kenntnis dieses Konkordats verstanden werden.
