LIBRE CONVENCIMIENTO JUDICIAL Y VERDAD: CRÍTICA HERMENÉUTICA A LAS TEORÍAS DE FERRAJOLI, TARUFFO Y GUZMÁN

Abstract

El presente texto, realiza un análisis acerca de los presupuestos teóricos que defienden el concepto de libre convencimiento judicial en la legislación y en el imaginario del derecho brasileño. Con este objetivo, tras la introducción, en que se presenta de modo sintético una cronología del instituto en la legislación brasileña, se realiza, en el segundo tópico, un análisis de los abordajes de Luigi Ferrajoli, Michele Taruffo y Nicolás Guzmán acerca del tema. A partir de la exposición de presupuestos teóricos comunes a estos autores, se desarrolla en el tercer tópico una crítica a sus ideas que mantienen la defensa del libre convencimiento. Tal crítica está desarrollada bajo el plan de fondo de la hermenéutica filosófica en diálogo con otras corrientes. Por fin, se concluye que la defensa teórica del concepto de libre convencimiento se revela insuficiente delante de los contra-argumentos presentados, y se sugiere un nuevo modelo de racionalidad judicial pautado por la necesidad epistémica y política de justificación.
