This article presents the analysis of the Russian Federation Constitutional Court`s case on the consequences of revocation by the pledgee of the Executive document involving the imposition of penalties on the mortgaged property. The conclusion is that the omission of the term for presentation of the Executive document should be recognized as the basis for the claim of the pledger on the recognition of rights (encumbrances) gone. Systematic abuse of the right of pledge is defined as a formally legitimate heterogeneous behavioral acts (actions and inactions) that does not have a direct economic motivation, performed by the mortgagee for the purposes of transposition of negative consequences and economic risks associated with the pledge, on the owner of a property.

Анализируется позиция Конституционного Суда Российской Федерации по вопросу о последствиях отзыва залогодержателем исполнительного документа, предполагающего наложение взыскания на заложенное имущество. Делается вывод, что пропуск срока на предъявление соответствующего исполнительного документа должен расцениваться как основание для удовлетворения иска залогодателя о признании права (обременения) отсутствующим. Систематическое злоупотребление правом залога определяется как формально правомерные неоднородные поведенческие акты (действия и бездействие) залогодержателя, не имеющие прямой экономической мотивации, направленные на переложение негативных последствий и экономических рисков, связанных с залогом, на собственника вещи.
