Abstract

RESUMO: Contexto: A teoria do Direito, desde o século XIX, é conduzida preponderantemente pelo positivismo jurídico. Mas, desde meados do Século XX, o surgimento da visão constitucional do Direito questiona seus paradigmas. Problema: Restam dúvidas se essa nova visão efetivamente estrutura uma nova teoria para o Direito, a começar, pelo viés científico. Objetivos: A pesquisa desenvolvida visou esclarecer exatamente isso, quais foram os novos paradigmas propostos por essa novel visão e se eles são suficientes para se enxergar um novo viés científico para a teoria do Direito. Método: Fez-se uma revisão narrativa de material bibliográfico, para que o pensamento positivista (traduzido de modo especial por Bobbio) fosse contraposto ao pensamento constitucionalista hodierno. Resultados: O positivismo propugnava uma ciência neutra, do ser; o constitucionalismo, uma ciência do dever-ser e o neoconstitucionalismo, uma ciência comprometida, do chegar a ser. Considerações finais: há um viés científico novo e maduro que sugere ser possível defender uma nova teoria do direito, uma teoria neoconstitucional.
