Abstract

Introducción: El artículo profundiza en los diseños industriales, teniendo en cuenta su impulso decisivo en la industria y el comercio, así como la importancia de seleccionar una apariencia especial en cada objeto, ya sea para su reproducción, comercialización o simple exhibición, siempre con la idea de hacerlo único y atractivo. El diseño industrial debe encaminar sus resultados a la captación del interés de la clientela, en vísperas de incentivar el comercio y contribuir a un mercado de libre competencia. Tiene como objetivo: analizar los diseños industriales dentro del mundo de la innovación, desde sus nociones generales hasta lo regulado en el Decreto Ley cubano 290 del 2012. La investigación se ha realizado apoyándose en los siguientes métodos teóricos: histórico-lógico, análisis-síntesis, abstracto-concreto, inductivo-deductivo. Se utilizó el método hermenéutico como método teórico específico de las investigaciones jurídicas. Dentro de los empíricos de utilidad para la investigación se trabajó con la observación no participante o externa y con el análisis de contenido. Los principales resultados esperados son: identificar el tratamiento que se percibe en el marco legislativo cubano respecto a los diseños industriales. La conclusión a la que se arriba es: su adecuada regulación permite asegurar los derechos exclusivos de sus titulares y delimitar las barreras frente a terceras personas, además de incentivar la estética de los productos y concretar su necesaria protección.

Introduction: The article delves into industrial designs, taking into account their decisive impulse in industry and commerce, as well as the importance of selecting a special appearance in each object, whether for reproduction, marketing or simple display, always with the idea to make it unique and attractive. Industrial design must direct its results to capturing the interest of customers, on the eve of encouraging commerce and contributing to a free competitive market. Its objective: to analyze industrial designs within the world of innovation, from its general notions to what is regulated in Cuban Decree Law 290 of 2012. The research has been carried out based on the following theoretical methods: historical-logical, analysis-synthesis, abstract-concrete, inductive-deductive. The hermeneutic method was used as a specific theoretical method for legal research. Among the useful empirics for the research, we worked with non-participant or external observation and with content analysis. The main expected results are: to identify the treatment perceived in the Cuban legislative framework regarding industrial designs. The conclusion reached is: its adequate regulation makes it possible to ensure the exclusive rights of its owners and delimit the barriers against third parties, in addition to encouraging the aesthetics of the products and specifying their necessary protection.
