Abstract

O arcabouço normativo do Direito Administrativo brasileiro é nitidamente voltado ao combate à corrupção. Isso não impede, naturalmente, que atos administrativos viciados sejam emanados a todo instante. A questão que suscita alguma dúvida é se tais atos, maculados desde a sua expedição, que geram ou geraram efeitos, produzindo vantagens a indivíduos de boa-fé, podem ser objeto de imediata e definitiva expulsão do sistema jurídico pela declaração de sua invalidade com efeitos retroativos, ou se devem ser preservados. O debate gera alguma controvérsia diante da afronta que o ato de corrupção promove ao ordenamento jurídico. No entanto, em algumas hipóteses, mesmo essa situação, pode gerar o dever de o administrador público promover a convalidação do ato de corrupção, como ao longo desse estudo sustentaremos.
