
Frente al texto de Núñez Vaquero, se desea esclarecer la insuficiencia de la súmula y de la tesis para la identificación de la ratio decidendi. Además de eso, se presenta la cuestión de las decisiones plurales, nacida en el derecho estadounidense, para demostrar la importancia de la individualización del fundamento compartido por la mayoría de los jueces del colegiado. Se concluye que, sin la justificación aislada de los fundamentos adoptados por los jueces, no hay cómo identificar la ratio decidendi.
