En lo que sigue voy a explorar el potencial explicativo y normativo de la tesis de la argumentación autónoma de Jan Sieck-mann. Con ese propósito, en una primera parte se propone una reconstrucción de la tesis de la argumentación autónoma en el marco de una comprensión deliberativa de la democracia y una teoría no positivista del derecho. En la segunda parte se analizan dos procesos políticos constitucionales con el objetivo de probar el marco conceptual desarrollado en la primera parte.
