
A los fines de abordar este tema partimos de dos premisas: primero, que el derecho a la salud es un derecho humano; y segundo que el paciente de salud mental necesita mayor protección por ser una persona vulnerable. Los derechos a la salud y a su preservación tienen anclaje constitucional ya que están reconocidos de modo implícito en el art. 33, y de manera explícita en el 75 inc. 22, que recepta los tratados de derechos humanos con jerarquía constitucional. Todo esto nos lleva sin lugar a dudas a una tesis de mínima: el paciente merece una amplia protección ya que como paciente es una persona vulnerable. A ello debemos sumar que como paciente con padecimiento mental también debe considerárselo como una parte débil, lo que lo vuelve doblemente vulnerable o personas hipervulnerables o de alta vulnerabilidad, el que sin ninguna duda debe ser protegido por el Estado.
