Abstract

Glosowany wyrok porusza szereg istotnych zagadnień związanych z wykładnią dyrektywy 93/13. Trybunał omawia dopuszczalność wyłączenia nieważności umowy i zastąpienia niedozwolonego postanowienia umownego przepisem prawa jak też zasady rozliczeń stron w razie nieważności umowy zawierającej niedozwolone postanowienia umowne. Zwłaszcza to ostatnie ma bardzo duże znaczenie praktyczne, odpowiedź Trybunału również wymaga zaś szerszego omówienia w kontekście regulacji polskiego prawa.
