Rozstrzyganie konfliktów między członkami rodziny a dobro dziecka

Abstract

Przedmiotem artykułu jest ważny współcześnie, z perspektywy prawa, ale także szeroko rozumianych nauk społecznych (pedagogika, psychologia) temat uwzględnienia dobra dziecka w razie konfliktu między członkami rodziny. Autorka ukazuje instrumenty wypracowane przez system prawny w zakresie ochrony interesów poszczególnych członków rodziny, w szczególności interesu małoletniego w razie konfliktu. Rozważania obejmują materialnoprawne podstawy rozstrzygania sytuacji konfliktowych między członkami rodziny ze szczególnym uwzględnieniem realizacji postulatu dobra dziecka w każdym stadium postępowania i niezależnie od osobistej sytuacji rodziców dziecka.
